Welcome to Starkie AI. By accessing or using our AI-powered image generation services (the “Services”), you agree to comply with and be bound by these Terms and Conditions (“Agreement”), as well as our Privacy Policy and other related policies. If you do not agree, you must not use the Services.

This Agreement is entered into between you (“User” or “Customer”) and Starkie AI, and governs your use of the Services and the digital assets generated through it (“Assets”).

1. Service Availability and Quality

Starkie AI may modify, suspend, or discontinue any aspect of the Services at any time. All services and Assets are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied.

You use the Services at your own risk. We make no guarantees regarding the availability, uptime, or accuracy of the generated content.

2. Age Requirements

You must be at least 13 years old to use Starkie AI. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement and consent of a parent or legal guardian.

3. User Data and Privacy

By using the Services, you may provide personal data. Both parties agree to handle such data in accordance with applicable data protection laws, including GDPR where relevant. Please refer to our Privacy Policy for more information.

4. Intellectual Property Rights

  • Your Uploads: You retain ownership of any input or content you upload to the platform.
  • Generated Assets: Starkie AI retains the intellectual property rights to all AI-generated Assets, but grants you a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute them, provided you comply with this Agreement.

You may not:

  • Use Assets for unlawful, libelous, obscene, or infringing purposes;
  • Claim the AI-generated work as entirely human-created when not true (e.g., for contests requiring original, non-AI art).

5. Copyright Infringement & Takedown Policy

We comply with DMCA and similar regulations and will review all claims promptly.

6. Dispute Resolution and Governing Law

This Agreement is governed by the laws of the United Kingdom, without regard to conflict of law provisions.

Any disputes not resolved informally within 30 days will be resolved through binding arbitration conducted in the United Kingdom, in English. Either party may seek injunctive relief in competent courts.

Each party bears its own legal fees unless otherwise awarded by the arbitrator.

7. Subscription Plans and Rate Limiting

Starkie AI may offer “unlimited” subscription plans, which may still be subject to fair use limits to ensure platform stability and equitable access for all users.

8. Payments and Refunds

Payments are processed through third-party providers (e.g., Stripe, PayPal). Refunds are issued at the discretion of Starkie AI. For technical issues, credits will be refunded to your account.

9. Community Guidelines

To maintain a safe and respectful environment, you agree not to:

  • Generate or share content involving hate, harassment, adult/gore material, or unlawful acts;
  • Impersonate others or misrepresent your affiliation;
  • Share generated Assets publicly without proper usage rights or attributions (where required).

Violations may lead to account suspension or termination.

10. Limitation of Liability and Indemnification

Starkie AI is not liable for any damages, losses, or claims arising from the use or inability to use the Services or Assets.

You agree to indemnify and hold harmless Starkie AI and its affiliates from any claims, costs, or damages resulting from your breach of this Agreement or misuse of the Services.

11. Miscellaneous

  • Force Majeure: Starkie AI is not liable for delays or failures caused by events beyond its reasonable control.
  • No Agency: This Agreement does not create any agency, partnership, or employment relationship.
  • Severability: If any part of this Agreement is found invalid, the remaining provisions remain in effect.
  • No Third-Party Beneficiaries: Only the parties to this Agreement may enforce it.
  • Survival: Provisions that by their nature should survive termination shall remain in effect.
